Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Habitin mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

We may modify these Terms at any time. We will notify you of changes by posting the new Terms within the App or via email. Your continued use after changes constitutes acceptance.

2. Account and Registration

To use the App, you must create an account by signing in with Google or Apple. You agree to provide accurate information during registration.

Age Requirement: You must be at least 13 years old to use the App.

Account Security: You are responsible for maintaining the confidentiality of your account and for all activities under your account.

Account Deletion: You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms.

3. User Content and Data

Ownership: You retain all ownership rights to the content you create in the App ("User Content"). You grant Habitin a limited, non-exclusive license to store, process, and sync your User Content solely to provide the service.

Responsibility: You are solely responsible for your User Content and represent that it does not violate any third-party rights or applicable laws.

Data Deletion: Upon account deletion, your User Content will be permanently removed from our servers, except where retention is required by law.

4. Subscription and Payments

Habitin offers a free tier with limited features and a paid Pro subscription with additional features. Feature availability may change over time.

Billing: Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.

Auto-Renewal: Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple account settings. You will retain Pro features until the end of your paid period.

Refunds: All purchases are subject to Apple's refund policy. For refund requests, please contact Apple Support.

Restore Purchases: You can restore previous purchases through the App if you reinstall or switch devices.

5. Prohibited Use

You agree not to:

  • Use the App for any illegal activities
  • Reverse engineer, decompile, or disassemble the App
  • Attempt unauthorized access to our systems or networks
  • Interfere with or disrupt the App or servers
  • Transmit viruses, malware, or other harmful code
  • Impersonate another person or entity
  • Scrape, data mine, or harvest data from the App

6. Intellectual Property

The App, including its content, features, design, and trademarks, is owned by Habitin and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

7. Service Availability

We do not guarantee that the App will be available at all times or be free from errors. We may modify, suspend, or discontinue any aspect of the App at any time.

The App is designed to work offline. Data synchronization and account authentication require an internet connection. We may require you to update to a newer version to continue using the service.

8. Disclaimer of Warranties and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Habitin operates. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

If arbitration is not enforceable in your jurisdiction, disputes shall be resolved in the courts of the jurisdiction in which Habitin operates.
